Terms and Conditions

The following terms and conditions apply to any courses delivered by TR Driver Training and its website (www.trdrivertraining.co.nz)

Acceptance of Terms and Conditions

As a user, course registrant (paid, direct credit or on account) or submitter of online forms on the TR Driver Training website (www.trdrivertraining.co.nz), or engaging TR Driver Training Services to deliver services, you accept these terms and conditions.

These Terms and Conditions have the following expressions and meanings:

  • 'Service', 'Services' means any service that is provided by TR Driver Training including training courses;
  • 'We' and 'Us' and 'Our' are reference to TR Driver Training and the TR Group of companies;
  • 'You' and 'Your' are reference to users and/or browsers of the TR Driver Training Services website;
  • 'Website' means the TR Driver Training website www.trdrivertraining.co.nz;
  • 'Product' means any product or training service or course that is offered for registration, sale and/or purchase on the TR Driver Training website;
  • 'Customer', ‘Customers’ includes any person buying or registering for a service on the TR Driver Training website.


Changes to Terms and Conditions

These terms and conditions may be changed from time to time. All changes will be effective immediately upon posting changes on the website. It is the responsibility of all TR Driver Training customers to be familiar with the latest terms and conditions. Your on-going use of the TR Driver Training website represents your agreement to these terms and conditions.

Insurance and Indemnity

The client is responsible for all insurance related risk in respect of all vehicles, equipment and loads provided by them for use by their drivers / operators and our instructors in the conduct of any training.

Except where we have expressly accepted responsibility to you under these Terms, you will keep us protected against any legal action taken against us and pay us any costs, losses or expenses we incur in connection with your use of our website or any failure by you to comply with these Terms.

Service Guarantees

TR Driver Training’ provision of services are covered under the Consumer Guarantees Act. TR Driver Training provides fit for purpose training services with reasonable care and responsibility and skill.
Your rights for service provision and supply of service are covered under legislation. More information can be provided by The Office of the Privacy Commissioner.

Your Information

As a user of the TR Driver Training website you warrant that you have provided complete, accurate and current personal or business information. TR Driver Training may phone or mail you to verify these details. Without limiting any other rights or remedies we may have, you agree not to permit any other person to use your details or customer information for the purchase of services through the TR Driver Training website.

Course Schedule

The course schedule published on the website is subject to change without notice. Courses are updated as information comes to hand including the availability of spaces. While every effort is made to ensure that errors are omitted these may arise from time to time.
If information on the website is incorrect, registrants will be contacted and alternative options discussed.

Course Fees

Course fees are normally quoted verbally or in writing prior to course registration and/or can be obtained from our website. Course registration or attendance is confirmation that fees have been accepted by the client.
All prices shown on the website are in New Zealand dollars and subject to change without notice. Quoted prices exclude 15% GST (Goods and Services Tax).

Courier fees are not applicable to course material unless otherwise stated.

NZQA Credit Registration

As an NZQA accredited Private Training Establishment (PTE), TR Driver Training register NZQA Credits on behalf of the Student. NZQA credit registration is compulsory.
NZQA Credits are based on the credits available on a specified unit standard completed as part of a course. These credits are added to your record of learning held by NZQA. These are your credits and support your evidence of completion of unit standards and qualifications.
There is a cost to deliver the course, register the credits and administer the registration of credits. Direct costs from NZQA are passed on through the specified credit cost.
Where additional costs exist, these are mentioned on the course detail page – (E.G. NZTA Licence fees or costs associated with medical certifications)

Confirmation of Order / Course Registration

All customers will receive a confirmation of their registration via e-mail when payment is received, direct credit requested or on account selected for registration of a course through TR Driver Training website. Customers, following a course payment, will also receive an invoice with their order.

Receipt of the automated ‘receipt of registration’ from the website is not a confirmation of acceptance on a course.
A contact form submitted, onsite request form submitted or an email request sent is not a course registration.
Course registration is not confirmed until payment has been made, and prerequisites (if any) are met and verified.

Attendee Numbers

Where you are making a booking that includes more than one attendee; or booking a course on site, a minimum number of attendees is required. If the number attending changes:

  1. Additional fees will be charged for any increase in the number of attendees in accordance with the registration costs (advertised or agreed)
  2. A reduction of the numbers of attendee’s is subject to our cancellation policy or minimum number requirements.

Payment Terms

For clients with approved credit accounts the course fee is invoiced at the completion of each course. Full payment is required no later than the 20th of the month following the date of our invoice. Late or non-payment may incur collection and/or legal fees for which the client accepts full liability for by registering for, or attending, the course.

For clients who do not have an approved credit account, full payment is required on registration for the course. Pre-course or course material will not be handed out until full payment is received.

Online Payment

We accept payment for purchases made through the TR Driver Training website via credit cards (Visa and Master Card credit cards accepted only) or via Account to Account transfer. All charges are made in New Zealand dollars and include GST. Credit Card payments are processed at the time of your purchase via the DPS secure payment system. This is a secure payment gateway through DPS and security certificate verified for your protection. Note – credit card payments incur a 2% surcharge.

Direct Credit

By registering for a course using the direct credit option, course registration will remain a request only until registration is made. For popular courses it is recommended that payment is made promptly as paid registrations will be given priority.

On Account

To enable a payment on account, you must have a credit account with TR Driver Training, accepted prior to the registration of a course.
Please contact TR Driver Training Services if you wish to apply for a credit account.

Client Cancellation/Withdrawal/Refund Policy

TR Driver Training Services operates a strict Postponement and Cancellation policy. Notice of a cancellation or request for postponement must be made in writing to [email protected]. Should a customer wish to postpone or cancel attendance on a training course, 5 working days’ notice is required prior to the course date.

  • Where notice of cancellation is given at least 5 working days prior to the schedule course start, full payment less $50 is refundable
  • Where notice is less than 5 working days and greater than 72 working hours (3 working days) before the course date, 50% of the total course fee is refundable.
  • Any postponements or cancellations given with less than 72 working hours’ notice (including non-appearance or non-completion) will result in full course fees being charged.

We are happy to substitute course attendees provided they meet course criteria

TR Driver Training Services Course Cancellation/Abandonment

All practical training is subject to cancellation/abandonment in the event of unsafe or illegal conditions. Where possible the TR Driver Training instructor will make any decision relating to this in consultation with the nominated client representative.
This may be due to trainer availability (sickness bereavement etc…), venue availability or low course attendance for example. TR Driver Training will endeavour to deliver the course in the first instance with course cancellation a last resort.
While we do our very best to provide a minimum of 48 hours’ notice, from time to time the notice may be as little as 24 hours.
We will arrange for an alternative time and date for attendance and where you are not able to attend and return all course materials in original condition, a full refund of payments for the course is provided

Attendance

Where a start time for a training course is provided, this is the actual start time. Times are given to ensure that the learning required for the course can be delivered in the time specified.
TR Driver Training’ Trainers have the right to refuse entry to any attendee to a course that is already underway and the standard cancellation policy applies (see cancellation policy above).

Course Materials and Required Reading

Course material may contain pre-course reading and in some instances course assessments. Materials for pre-work in relation to any courses will be delivered following full payment for the course to ensure you have sufficient time to obtain required knowledge and complete the required assessments.

Emails, Newsletters and Reminders

TR Driver Training may send you emails relating to products purchased, transactions and other activities on the website, and for promoting and marketing other TR Driver Training product and services to you including new courses, notifications or specials on offer. TR Driver Training may also send regular electronic newsletters to customers. Newsletters will contain clear and obvious instructions on how you can unsubscribe from the mailing list. If you do not wish to receive these electronic emails, please contact us to have your name removed. Where a course is completed requiring a refresher in the future, these will be notified to you directly via mail, email, txt or phone.

Termination

We reserve the sole discretion, without notice, to terminate your account and ability to use TR Driver Training or our website services, if we believe that you have breached these Terms and Conditions. We may also in our sole discretion and without notice to You, stop providing some or all of the product and/or services or the TR Driver Training website as a whole.

Confidentiality / Intellectual Property / Copyright

The information provided in any proposal or quotation submitted by TR Driver Training Services is commercially confidential and it is not to be divulged to any other party.
The intellectual property of courses and course material is covered by copyright and may not be used or copied without written permission.

The material featured on the TR Driver Training website (www.trdrivertraining.co.nz) is the copyright of TR Driver Training unless otherwise indicated. It may not be reproduced in any format or medium, for use in commercial, non-commercial or informational purposes, without prior written consent from TR Driver Training. This is also subject to the material being reproduced accurately and not used in a misleading context. Where any of the copyright items on this site are being republished or copied to others, the source of the material must be identified and the copyright status acknowledged. The permission to reproduce copyright protected material does not extend to any material on this site that is identified as being the copyright of a third party. Authorisation to reproduce such material must be obtained from the copyright holders concerned. For any other proposed use of the material on this site, please contact TR Driver Training. Explain how and why you wish to use the materials. Please include your name, organisation, telephone number and email address.

Quality Assurance & Health and Safety

As part of our Quality Management System we have processes in place to internally and externally moderate and evaluate all our training and assessment, and have in place a formal Health and Safety Policy and Plan which our instructors are required to adhere to.

Continuity

As we deliver the same courses throughout the country in the event that a local instructor is not available for any reason we can bring in a replacement instructor who can deliver the same course thus ensuring consistency of content and quality.

General Terms

In the event of a dispute arising in relation to these Terms and Conditions, the New Zealand courts will have non-exclusive jurisdiction over such a dispute. If we do not exercise or enforce any right available to us under these Terms, this does not constitute a waiver by us of those rights. We may transfer this agreement or any benefit or obligation of this agreement to any person without notice to you. You may not transfer any benefit or obligation to any other person without our written consent. Each part of these Terms is separately binding. If for any reason any part cannot be relied on, all other parts remain binding.

Every effort is made to ensure that the information contained in this website is accurate to the best of TR Driver Training’ knowledge. Nothing on this website constitutes, or is meant to constitute, advice of any kind. If you require advice in relation to any legal, financial or medical matter you should consult an appropriate professional.
TR Driver Training makes no representations or warranties, either expressed or implied, as to the accuracy of the information on this website, or its fitness for any purpose whatsoever. In no event will TR Driver Training be liable for any direct, indirect, special incidental, or consequential damages arising out of the use of the information held on this website.

Privacy Act 2020

If you are an individual, you have rights under the Privacy Act 2020 to access information held by us, and to request the correction of such personal information. In respect of such personal information, You:

  • Authorise us to obtain personal information about You, via Your Registration Form and Your use of TR Driver Training and Our Services.
  • Authorise us to use Your personal information for direct marketing and promotional activities, research and development purposes, identity verification, and otherwise in respect of the provision of Our Services to You.
  • Agree that further notification to You of the purpose of the collection of Your personal information is unnecessary and non-compliance with the requirements of Principle 3 of the Privacy Act 1993 is authorised.

We encourage linking to our website in context and regularly review these. If you wish to share information on Social Media sites, we encourage this. However, by linking to this content, it remains subject to the terms and conditions as specified.
